Drosera Spatulata:
In the image below you can see is an illustrated version of the plant as it
matures. This listing is for a Dorsera 'Spatulata' shown below. The Drosera
Spatulata is a great addition to any carnivorous plant collection.
The plant produces spoon shaped leaf's which have
tentacles which are used to capture its prey which are used to capture its prey,
for example spider's, fly’s & moth's which is why they are ideal in a home
environment so as to capture those undesirable pests. It is also a plant that
fascinates children of all ages and adults. This is a hardy sundew that
tolerates our climate with ease, however can be grown outdoors in a greenhouse
(mainly during dormancy winter months) or indoors all year round to catch fly's,
as this plant does not require a dormancy period. This cultivar produces a white
flower as show below.
The plant originates from Southeast Asia, south China and Japan, Micronesia, New
Guinea, Australia, Tasmania and New Zealand.
It should be noted that you can only get a exact replication of a parent
cultivar through vegetative propagation, there is no other way even via seed. I
have the genuine cultivar from the creator, the starter plant you will receive
is child of the parent cultivar, meaning it's an exact replication of the
original.
You Will Receive:
I will be supplying one plant which will have exact genetics of the illustrated
plant shown below, however the plant size varies, as time elapses, so I've just
posted an illustrated version of the plant rather than having to re-photograph
the plant each time, however the strain is the most important factor here. I
have many years in keeping this exotic
plant, I am now a cultivar collector with the odd excess plant available, my
plants have been collected from around the world.
If you have any questions with regards to anything size or the cultivar please
ask! I'm here to help. As the sizes vary as time elapses, it's important that
you accept you may receive a slightly smaller plant of this strain prior to any
purchasing.
The item will be shipped promptly as possible, to which the plant will be sent
bare rooted. So please ensure you have the correct media ready to pot your plant
up, if not this can be arranged to be shipped with plant. Due to how delicate
this plant is, time is required for the plant to recover after shipping, brown
leaves can occur during dormancy after expiration this is a normal cycle for the
plant, the plant will replenish the leafs in due course. Plants having old leafs
removed will inevitably be reduced in size after the removal of any older leaf
that can be discarded which occurs during dormancy and leaf expiration. The
dormancy period start’s early October through to late February, during this time
the plant will reduces its leaf’s to the crown (centre of the plant). When the
temperature rises once more in the start of the growing season which beings
early March through to late September, the plant will quickly replenish the leaf
formation.
This plant is mature and can flower from 15mm in diameter. Approximate size of plant supplied will vary from 15mm diameter, as the dead or used leaves will be removed prior to shipping. Please note that these plants can be green in color when supplied, as the plant goes red when the light of summer intensifies.

perfidious attributes, so much so I have explained in great detail so everything
is covered and to give You the buyer a better understanding as to how we trade
together.
In summary:
You the purchaser are invited to treat Yourself to a product I am selling. You
the Buyer must read and understand the listing to know what You are purchasing,
this is re-enforced by the terms of Section 10 of the eBay policy user
agreement, upon which you the Buyer has agreed to trade on this platform. If
there is any doubt You must wait and ask prior to making any purchase from me.
This is to avoid any form of misunderstanding between us in the first instance.
Once the item has been purchased by You, I will endeavour to get the purchased
item to You in a safe and secure manner. Should any and all issues if any should
they arise, it will be dealt with through a dialogue on an eBay message service,
prior to the feedback process. This allows Me to resolve any issues You may
have. By You reporting the issue You allow Me to improve my level of service to
You, My consumer. If everything is as it is listed then there is no issue.

Note: Example of sale by sample (Picture on a listed item for sale may show a
photo of a daffodil in flower and not bulb, with that said not all daffodil
bulbs may have the exact shape as the one pictured if pictured, but You will
still have been furnished a daffodil bulb which will form into a flowering
plant. In addition You may see a picture of a daffodil plant pictured but You
are supplied a bulb, You have still been furnished the plant as the bulb is the
plant, just supplied in the seasonal state at that time.).
2.1.2 I may not be held accountable for photographic colour variations that can
occur as a result of a slight difference due to the lighting during the photo
shoot and calibration of each individual visual monitor or screen You have used
to see a listing page of picture within eBay's domain.
2.1.3 All written text within the listing page is subject to E&OE (Errors &
Omissions Excluded) which I will not be legally bound.
2.1.4 The purchase of goods or services forms a contract under the Sale Of Goods
Act 1979 Section 2 (1). This is reiterated in eBay's policy, as we are all part
of the eBay community we all need to comply to this.
2.1.5 It is My legal obligation to You as a private seller which has been
fulfilled as the item will be clearly described to You in the listing. If You do
not deem the item is described clearly to You upon Your perusal of the listing
in full prior to purchase, You are prohibited from purchasing the item.
3. Basis of Sale Contract:
3.1.1 I aim to trade in a legal and fair way that is easily understood by all
the parties concerned within the contract of sale. Nothing is designed to limit
what You are legally or even reasonably entitled to by UK law.
3.1.2 I will supply You with goods and services providing they are in as stated
in the listing and fit for transportation and will be described accordingly on
the listing to which You are required to read and accept prior to making any
form purchase from Myself. Failure to comply is a breach of eBays user policy
section 10.
3.1.3 In advertising my goods and services, I provide the opportunity to enter
into a trade agreement with Myself through my user alias of
on eBay's platform to which is making an offer of contract with You to treat
Yourself. This forms a legally binding process through which we can trade
together. This is concurred within the eBay user policy agreement.
3.1.4 In placing an order within eBays domain with Myself, it is understood that
You wish to trade and accept the contractual terms laid out before You here in
this listing. There are certain exceptions and provisions and it is these that
this document seeks to define to You.
3.1.5 You understand that no item on the a listing within eBay's domain will not
be sold outside of eBay. If You attempt to engage in any such communication with
myself, I will report this to eBay directly for investigation. If You found the
item on eBay You must purchase through the eBay's domain.
4. Prices:
4.0.1 You will purchase the item at the close of listing, The price that You
have accepted when viewing the listing, this may include postal costs and taxes
if purchased outside of the UK and others costs I may not be aware of.
4.0.2 You when making your purchase and view the listing You understand and
accept that You are indeed getting the value for the upon which there will be no
recourse by Yourself of statements that the item was not value for money paid,
as You agreed and know this at the time of purchase. If there is genuine reason
why the item is not deemed value for money You are expected to communicate this
with me in a open dialogue, prior to any other action by You so I have a means
to resolve this matter at hand for You.
4.0.3 Postal pricing is beyond my control, some items require more packing than
some other items these costs are accepted and paid by You. It is also understood
that You will not enter into the feedback forum anything that relates to the
postal cost, as it was deemed by You at the time of purchase to be right and
satisfactory at the time of purchasing.

4.2.0 Once any payment has been processed and paid in full by You, should any
due or outstanding fees be due to a third party these will settled by You within
14 days of receipt of notification to Yourself, as such there will be no
circumvention of eBay's fees, to which you will not hold me responsible for
making payment to any third party at any time on Your behalf.
5. Purchasing of an item listed:
5.1.0 Please ensure that You read these terms and the listing page in full
carefully and check that the details on the order are complete and accurate,
ensuring You know what You are purchasing before You submit to confirm Your
order to me.
5.1.1 As stated at the top of the listing page below the price it clearly states
there is "No Returns" policy meaning that no item will be accepted as a return,
upon which You agree when bidding on the auction format listing or using the buy
it now button on a listing.
5.1.2 In the event that I request for an item to be returned this must be inline
with eBay policy and UK law.
5.1.3 Once You have committed to the purchase of the item listed, You accept
there is no cancellation or return that can be issued, even if the consignment
has not made transit or in transit thereafter, until you have taken receipt of
the item purchased.
5.1.4 You should fully understand and know how to keep, look after and maintain
any animal, plant (perishable goods), or equipment that you decide to purchase
from Myself prior to purchasing it. When You have signed or taken receipt of the
item purchased the title of the item is then transferred to You upon which the
onus is on You for which You are responsible thereafter.
5.1.5 If you do not select for a signed for service then You will accept any
loss that may occur while the item is in the hands of the courier, an
investigation may occur thereafter to resolve the issue.
5.1.6 You are required within the terms of this agreement to ask any questions
You may have about the listed item within eBay's domain prior to purchasing, as
once you have bought the item You are then committed to complete the
transaction.
5.1.7 In the event that an item has not been delivered You are required to
inform Myself within 7 days after the time of dispatch, should a delivery
failure occur, so I may monitor and be aware there could be an issue that I need
to resolve for you.
6. Payments:
6.1.1 You must make payment accepted by eBay's policy within four days of the
date of purchase. See eBay's policy.
6.1.2 If You fail to make payment unless otherwise agreed in writing this would
mean on the 5th day from purchasing or winning an auction a non-payment can be
requested to eBay. After 5 days the seller can cancel the order for non-payment,
allowing for a fee credit and relisting of the item, thereafter eBay will raise
a strike against Your account for non-payment. (Please avoid non-payments you
can lose your account for doing so).
6 UPDATES REQUIRED
7. Collection of purchased item:
7.1.1 On the rare occasion You may be permitted to collect an item in person
due to the physical size and logistical issues that can be avoided when
collecting in person at an appointed time.
7.1.2 Item will be sold to you at the exact price you accepted to pay for the
item.
7.1.3 Collection in person is only permitted if it is clearly stated on the
listing prior to purchasing of the item. There can be no change from postage to
collection in person if postage has been selected and processed (this due to the
change of the contractual agreement between us). In this instance You may be
requested to accept the postal option selected or You may be asked to send a
cancellation request to Myself and risk the loss of purchase due to the format
upon which the item was placed.
7.1.4 A buyer has two methods of paying when collecting an item in person. Once
a time has been arranged to collect a Buyer may pay the exact cash payment, or
use the eBay's managed payment system on collection after the Buyer has fully
inspected the item. When the Buyer takes the item they have purchased or have
given Me the seller the QR code or the 6 digit pin, this is seen that the Buyer
has and is happy with and concludes the purchase transaction of the item and
there will be no recourse thereafter once the item has been collected by the
Buyer.
7.1.5 The price of the item will not be reduced because it has been collected in
person by You. The full price advertised will still be required to be paid in
full within 4 days from the time of purchase or close of auction formatted
listing.
7.1.6 All items collected by You must be paid either in cash GBP Sterling at the
exact price in full at the time of collection or prepaid through the eBay's
managed payment service prior to collection, where you will be issued a QR code
and a 6 digit code which must be furnished to Me the Seller at the time of
collection.
7.1.7 If an item is required to be collected in person by You from a different
storage location within eBay's address profile, this location will be indicated
on the listing where the first 3 characters of the postal area will be
displayed, with the exact location provided once the item is purchased.
Questions may be asked but no exact address location can be furnished until the
item has been purchased.
7.1.8 If there is a change to the orginal contractual agreement between us I
reserve the right to cancel without notice to You and not re-list or sell the
item to the original buyer as the contract between us will be deem null and
void.
7.1.9 In the event I require You to collect the item because the item will not
be shipped, You will be expected to collect the item within 7 days of notice to
You in writing. Failure to collect will result in an escalation to eBay, for
further investigation.
7.1.10 If a collection in person is agreed by Myself through the listing, an
appointment must be made prior to collection. This may be cancelled at any time
by Myself, to which a new appointment time may be reissued to You.
7.1.11 All rights reserved where I reserve the right to refuse a personal
collection at any time.
8. Dispatch Times:
8.1.1 I aim to ship Your order as soon as possible upon receiving a confirmed
purchase through eBay's domain, on a working day and not when You won or
purchased the item.
8.1.2 There will be no time constraint for me to dispatch any item in any given
time frame other than those stated within the listing on eBay and all times
offered on the eBay's website through the listing are an estimated guide, as
some elements of dispatching are beyond My control; for example courier
collection times and delays, weather conditions, and public holidays which are
all delaying factors beyond my control. However every effort is taken so that
Your item is dispatched for You to receive promptly.
8.1.3 The following days; Saturday, Sunday and Public Holidays there will be no
such service therefore not to be construed as a working day for Myself, to which
You accept the first opportune moment for dispatch will be the next available
working day
8.1.4 Combining consignments for shipping is not available in general; this is
because it is not always possible or ethical for this to be completed because
the postage cost is directly proportionate to the parcel weight on every gram,
as such You will be charged the full price, unless pre-arranged with Myself
prior to Your purchasing of the items listed.
8.1.5 You agree to observe the dispatch times presented to you on the listing,
to which the listing of a item is subject to change without notice.
8.1.6 You agree You will not hold me accountable for any delays in dispatching
an item to you, (As some delays can be beyond my control which lay with the
courier pre-selected and not myself wanting to dispatch the item to you.) nor
relay courier related issues information through the Feedback Forum. I have to
select pre-determined couriers chosen by eBay to use, any poor service received
by the courier to Yourself is a reflection of eBay's selection of courier, and
not myself. I am responsible for only the preparation of the item and the
dispatching within the time frame stated within the listing. (Any such feedback
concerns will be raised with eBay for further investigation).
9. Shipping Address:
9.1.1 You will have Your item shipped to the confirmed address held by eBay at
the time of checkout only! (Please be sure to double check this at the time to
select the correct delivery address, as it will not be changed there after.)
9.1.2 To comply with the eBay user policies; address variation request via email
will not be accepted. If You decide to have the item shipped to an alternative
address (other than the confirmed address by You at checkout) which does not
comply to the (address submitted by You). You the buyer must either accept the
address that was submitted at checkout for delivery of your item or request for
the order to be cancelled by You the buyer, this is so that the seller
protection policy is maintained.
9.2.5 Parts of Ireland and The Channel Islands are not classed as part of the UK
mainland and as such will not be eligible for free shipping where it may apply.
I reserve the right to charge for the additional shipping and handling under
section 10.1 should Your item be in the following postcodes listed in section
9.1.7.
9.2.6 Where offered Free UK postage does not apply to section 9.7.

10. Packaging & Labelling:
10.1.1 You are duty bound to pay for any shipping or handling incurred that may
be required to ensure the consignment may be dispatched in a secure manner to
you. I reserve the right to change courier and upgrade the postage at any time
without notice to Yourself, to which further charges may apply.
10.1.2 I will only send the items purchased and ordered by You the purchaser, to
the address You supply eBay which is a confirmed address, which also forms part
of the legally binding contract.
10.1.3 You are expected to receive the consignment in good time so that the
contents of the items purchased do not deteriorate. I cannot be held responsible
for delays by the level of service that has been given to You by the courier
that has been selected. The onus is upon You to request a level of service if
not currently presented.
10.1.4 Should You require a next day delivery this should be arranged or
selected prior to committing to Your purchase.
10.1.5 Loss or damage caused by a delay that You are responsible for will be at
Your risk and cost.
10.1.6 I will pack and label the consignment so as to comply with all the
legislation and requirements.
10.1.7 You also accept You will receive the goods as arranged and not break the
trust I place in You by failing to make arrangements to obtain your consignment
in good time, by seeking its location for collection.

11. Transit Time:
11.1.1 You accept that the transit time can vary considerably based on the
destination, method and courier all of which are beyond my control to which You
will not hold me accountable.
12. Receipt of Consignment:
12.1.1 Your item may require a signature to confirm that You have taken receipt
of the consignment.
12.1.2 If the item does not have a signature the consignment will be deemed as
being received by and accepted by You, which is classed as standard delivery
which is without a Tracking Reference Number.
12.1.3 Your signature upon receipt confirms that You have checked and accepted
the consignment's contents are as they should be free of damage upon receipt.
You will not pursue any claim or request a refund through eBay from Myself
thereafter, as the item will be deemed as described in the listing as the
consignment has been checked and accepted by You.
12.1.4 If for any reason You are unavailable to accept the consignment, then the
consignment will be held at Your local mail sorting office of the courier that
was used and will be waiting for collection by You.
(Note: example the Royal Mail only holds such mail for a a period of 18 days.
However the Royal Mail need 2 days to process a redelivery, which means You in
effect have only 16 days to collect Your consignment, please ensure You collect
within the 16 day time frame.)
12.2.6 Any cost incurred by You for collecting the item from the mail sorting
depot is purely at the cost of the You the buyer.
12.2.7 When Royal Mail or any other courier company place a charge at the time
of the delivery it will be responsibility of the recipient to pay for this to
ensure that the item is received in good time to prevent loss or damage to the
item therein.
13. Returns:
13.1.1 As stated at the top of the auction page below the price clearly states
there is "No Returns" meaning that no item will be accepted as a return by You.
13.1.2 I reserve all rights to refuse any return.
13.1.3 Once You have committed to the purchase of the item You accept there is
no cancellation available thereafter unless authorised by Myself in advance in
writing.
13.1.4 Clear photographic evidence will be required of the item (s) and label of
packaging prior to a return even being considered. In such event that I have
accepted or requested a return of the consignment this must be in the same
condition as it was shipped in and returned within 14 days of the dispatched
date.
13.1.5 Any refund will be to You given through eBay.
13.1.6 In the event that I accept total responsibility for the item returned,
the item returned must be in the exact condition it was sent to you, so a full
refund will be given. You the consumers can be held liable for diminished value
if they handle goods under the following acts of UK law, specifically the
Consumer Contracts Regulations 2013 and Consumer Rights Act 2015
13.1.7 In the event that You return an item that was not in the condition
dispatched to you, You could be liable under the Fraud Act 2006 Section 2 (1) b
(ii) (A Criminal Offence). (Note: this is for those that seriously abuse the
returns policy within eBay's platform).
13.1.8 Should You ship an item for return that has not been accepted as a
return, You understand that there will not necessarily be any refund and You
agree to transfer the title of goods purchased by You to Myself without charge
allowing me to do as I will with the item thereafter.
13.1.9 You agree that upon sending a message by electronic means stating that I
can retain the item, I will then be able to do as I will with the item
thereafter and You will waver all rights of possession of this item and title
thus therefore title is transferred to myself.
13.1.10 You accept that all live or perishable goods are non-returnable upon
taking receipt this is because they are and will not be in the same condition as
they were sent in.
13.1.11 You accept that any unauthorised returns not accepted by myself or upon
cancelling a transaction under any circumstances, You forfeit the right to
purchase from me in the future. (However please email me your concerns so I may
act to resolve this for you, prior to an unauthorised return). All unauthorised
returns will be reported to eBay for further investigation.
13.1.12 You accept where an item has been used tried or tested while in your
possession, the item will be deemed as used by You which means the item becomes
second-hand from new and third-hand from second hand to which there is no refund
or return available.
13.1.13 If a replacement is received by You, you will actively seek to close any
opened cases on any platform and actively assist with Myself to have any
feedback removed written by yourself.
13.1.14 In the event that I require the item purchased to be recalled without
dispute You the Buyer will be expected to pay the return postage to me.
14. Claims:
14.1.0 I understand sometimes claims have to be made, however there is a
procedure that has to be followed, herein.
14.1.1 You agree that You have the ability and competence to be able to send
photos / and video content. In any such event You are requested, after you have
notified myself of such an issue that has occurred and this allows me to support
you prior to proceeding with any claim you may have.
14.1.2 Your item upon return to Myself for a claim issued by You will be
documented electronically, whereby the item will be filmed when opening the
consignment which should match that of the digital shipping evidence prior to
the dispatch from Myself. If there is an issue that has not been reported to Me
prior to shipping a return of the item the supporting evidence will be submitted
to eBay for further investigation.
14.1.3 Any false claim made by You to Me or any courier can and will be subject
to the Fraud Act 2006, which can be reported to the Police as a criminal
offence, for further investigation. (This is standard practice for those trying
to commit a genuine fraud against a seller).
14.1.4 An item is not normally deemed as lost until 14 days after the dispatch
date.
14.1.5 You accept not to leave damaging results under the Detailed Seller
Ratings or under the feedback forum for items that have been delayed in the
post. You are urged to communicate your concerns so I may aim to resolve these
for you within the permitted time frames allocated.
17. Local Tariff & Taxes:
17.1.1 If Your country charges for any import tariff or taxes, it is Your
responsibility as a citizen of that country to pay for the taxes due incurred on
that item.
17.1.2 I will not be liable if Your country's Customs department detains Your
parcel.
17.1.3 I will not be held liable if the consignment containing Your item is
damaged, lost or destroyed by Your country's Customs.
18. Communication:
18.1.1 You the Purchaser accept to be contacted via eBay's message service or
forum, email, telephone and by standard mail so as to resolve any matter at
hand, so that additional content may be sent to You. This will be used to find a
remedy and will not be deemed as harassment by Yourself.
19. Data Retention:
19.1.1 I reserve the right to retain all information in regard to the
transaction and You the Purchaser. This is for legal reasons.
