L'acquisto immediato di questo oggetto comporta da parte dell'acquirente l'espressa rinuncia a quanto previsto dall'art. 63 del Codice del consumo in merito al passaggio del rischio di cui alla normativa al 25.10.2025 capo 1 e 2, ovvero l'acquirente accetta che in caso di ritardo, mancata o danneggiata consegna, il rischio si trasferisca all'acquirente già nel momento della consegna del bene da parte del venditore al corriere vettore, anche se quest'ultimo non sia stato scelto precisamente dal consumatore ma sia stato proposto dal professionista. E' comunque facoltà dell'acquirente scegliere effettivamente il corriere preferito e inviarlo a prelevare la merce concordandolo solo prima dell'acquisto o annullando l'acquisto effettuato per problemi con la spedizione, in caso contrario si procederà con il servizio offerto dalla società Auctane convenzionata con eBay. L'acquirente in questo caso rinuncia espressamente alla richiesta diretta di rimborso a eBay società gestore del sito o al venditore impegnandosi a rivolgersi direttamente alla società di trasporti o mediazione di trasporto incaricata alla consegna in caso di ritardo, mancata o danneggiata consegna sollevando il venditore da ogni obbligo dal momento della consegna del bene al corriere vettore e indicazione del numero di tracking all'acquirente. Il venditore si impegna a comunicare alla società di trasporti o mediazione di trasporto incaricata alla consegna la rinuncia a ogni rimborso a favore dell'acquirente a cui detta società sarà responsabile in solido. Per ogni controversia l'acquirente e il venditore riconoscono l'esclusiva competenza dell'Ufficio del Giudice di pace di Milano.
