SECTION 20 - GUARENTEE
All guarantees for products are provided entirely by the manufacturers/UK importers and are subject to terms contained therein. Purchasers are reminded to complete and return all warranty cards/documents upon receipt of goods where appropriate.
The warranty is limited to defects recognised by our technical department and to normal use and excludes items subject to normal wear and tear (e.g. gaskets, rubbers, clamps). The Guarantee extends only to the value on replacement, of the accepted goods by the Company as faulty from the original user and does not cover any consequential loss or damage or any other expenses.
The Goods must be returned to Wicks Performance Engineering Limited at the buyer’s own cost, together with the sales invoice (plus supply invoice if trade resale) in the event of any claim arising.
The Guarantee does not cover defects or faults which may arise by reason of accidental damage, neglect, misuse, modification, improper installation and maintenance, wrongful application or competition use. In addition, the Guarantee does not include where damage has been caused as a result of any defect or malfunction of any other part of the vehicle including non-approved accessories. All claims must be supported with proof that a trained, competent professional has undertaken the original installation of the component e.g. works invoice / workshop job card.
The Company does not guarantee that any product or component are suitable to be used on vehicles which are to be driven on the public highway and cannot accept responsibility for components which do not meet legal requirements.
No guarantee is applicable where parts have been used in non-standard applications (i.e racing / track use or in conjunction with a nonstandard component to the vehicle the component was supplied for) The Buyer must follow the current procedures for warranty claims as specified by Wicks Performance Engineering Limited and the Company reserves the right to change procedures at any time with written notification.
SECTION 21 - RELEASE OF LIABILITY
I, the Buyer, understand and appreciate Wicks Performance Engineering Ltd trading as MazSpec (“Seller”) provides new automotive parts, accessories, and consumables.
I, the Buyer, do hereby agree that Wicks Performance Engineering Ltd has no control over the installation and use of parts once sold. I also understand that Wicks Performance Engineering Ltd highly recommends that certified professionals install all parts that it sells.
I, the Buyer, agree that I rely on my own skill and judgment in evaluating the installation of parts bought from Wicks Performance Engineering Ltd, and I agree that I am solely responsible for the part’s use.
I, the Buyer, agree to hold the Seller Wicks Performance Engineering Ltd harmless from, and hereby assume the entire responsibility and liability for, any and all damage or injury of any kind or nature whatever, including death, as to all persons, whether Buyer's employees, agents or otherwise, and as to all property, including Buyer's own property, caused by, resulting from, arising out of, or occurring in connection with the use by Buyer or any other person, of any parts, or vehicle serviced by and or purchased from Wicks Performance Engineering Ltd
I, the Buyer, agree that if any person makes a claim for any damage or injury, including death, resulting from the use of the parts, vehicle Buyer purchased from Seller, whether based upon Seller's alleged active or passive negligence, or based upon principles of product liability, or based upon any alleged breach of any statutory/contractual or common law duty or obligation Seller may have, I shall defend, indemnify and hold harmless Seller, its agents, servants and employees, from and against any and all loss, expense, damage or injury that Seller may sustain as a result of any such claim.
All used parts must be inspected by buyer for defects or safety hazards. Wicks Performance Engineering Ltd in no way guarantees or warrants parts or vehicles for apparent or non-apparent safety hazards and affirmatively states that used parts or merchandise sold may have safety hazards, and it is the responsibility of buyer to inspect for actual or latent safety hazards or hire an expert to so inspect.
Buyer affirms that before they has entered into this agreement. Wicks Performance Engineering Ltd requested that buyer examine the parts, to ascertain whether there were defects therein; Wicks Performance Engineering Ltd. afforded to buyer an adequate opportunity to make such examination before he entered into this agreement and that he has examined the goods as fully as buyer desires for the purpose of determining whether there are defects.
I, the Buyer, for myself and anyone entitled to act on my behalf, waive and release Wicks Performance Engineering Ltd, its members, shareholders, officers, directors, agents, volunteers, and employees, from all claims or liabilities of any kind.
