1. Kauf
Mit dem Kauf der angebotenen Vertragsprodukte auf Ebay und in unserem Webshop akzeptieren Sie unsere AGB und nachfolgende Richtlinien.

Sie erhalten automatisch nach dem Kauf an Ihre bei eBay hinterlegte E-Mail-Adresse eine E-Mail von uns. In dieser E-Mail werden Sie gebeten, Ihre Kontaktdaten anzupassen (Link, um Ihre Kontaktdaten anzupassen), sowie über den Versand- und Zollprozess informiert.
Sollten diese zwingend benötigten Daten nicht spätestens 5 Stunden nach dem Kauf aktualisiert sein, wird der Artikel an die bei eBay hinterlegte Adresse versendet.
Danach lehnen wir jeglichen Support gemäss unseren AGB ab, z B. Zustellprobleme, Rücknahme bei Zollproblemen, Weigerung der Zahlung von gesetzlicher MWST, Rechnungsänderungen usw. Der Versand erfolgt grundsätzlich immer am gleichen Tag, wenn wir die Daten bis 14:00 MEZ erhalten haben.

Sobald die Daten aktualisiert und der Artikel bezahlt wurde, erhalten Sie unsere Auftragsbestätigung inkl. AGB und Rückgaberichtlinien. Es gelten ausschliesslich die AGB und Rückgaberichtlinien der plc-auction.

2. EORI | USTID
Gewerbliche Käufer aus der EU müssen zwingend Ihre EORI Nummer mitteilen. Ohne diese Nummer kann nicht versendet werden. Es reicht auch, wenn Sie uns eine Kopie der Anmeldebestätigung der EORI per Mail zusenden.

Die Preise verstehen sich exklusive CH Mehrwertsteuer.

5. Versand International „Incoterms CPT 2020“

«Incoterms CPT» verpflichtet den Verkäufer plc-auction, falls zutreffend, die Ware zur Ausfuhr freizumachen.
Jedoch hat der Verkäufer plc-auction keine Verpflichtung, die Ware zur Einfuhr freizumachen, Einfuhrzölle zu zahlen oder Einfuhrzollformalitäten zu erledigen.

CPT- Carriage Paid To (.. benannter Bestimmungsort)
Incoterms "Carriage Paid To"|"Frachtfrei" bedeutet, dass der Verkäufer die Ware dem Frachtführer oder einer anderen vom Verkäufer benannten Person an einen vereinbarten Ort liefert.
Zusätzlich hat der Verkäufer den Beförderungsvertrag abzuschliessen und die für die Beförderung der Ware bis zum benannten Bestimmungsort entstehenden Frachtkosten zu zahlen.

6. Zollgebühren | Zollabfertigung | Steuern | Incoterms
In den Zollformularen für Pakete, die in Länder ausserhalb der Schweiz verschickt werden, wird der Wert der in der Lieferung enthaltenen Artikel nach Produkttyp aufgeführt.
Wir behalten uns vor, dem Zoll zur Vereinfachung des Verfahrens für unsere Kunden oder aus gesetzlicher Verpflichtung solche Angaben zu machen.
Der Zoll kann Pakete zur Kontrolle öffnen, wir haben darauf keinen Einfluss. Zoll- oder Einfuhrgebühren werden erhoben, sobald das Paket Ihr Land erreicht hat.
Gebühren für die Zollfreigabe gehen zu Ihren Lasten. Zusätzliche Gebühren für die Zollabfertigung müssen vom Empfänger getragen werden; wir haben keinen Einfluss auf diese Gebühren und können ihre Höhe nicht vorhersagen. Die Zollbestimmungen variieren von Land zu Land beträchtlich. Für weitere Informationen kontaktieren Sie bitte Ihre Zollbehörden vor Ort.
Alle anfallenden Einfuhrgebühren in Ihr Land müssen von Ihnen übernommen werden. „Incoterms CPT 2020“

Anmerkung: Die Zollbehörden einiger Länder verlangen vom Importeur einer Ware einen speziellen Identifikationsnachweis, bevor eine Sendung freigegeben wird. EORI Nummer, nationale Identifikationsnummer, CPF oder Steuernummer, aufgefordert werden.

Je nach Ermessen des Falles behalten wir uns vor, eine Anzeige bei Ihrer Zollbehörde einzureichen.

plc-auction stellt keine T-Dokumente und Ursprungsnachweise aus.

7. Produktspezifische Lieferbeschränkungen
Die Vertragserfüllung seitens plc-auction steht unter dem Vorbehalt, dass der Erfüllung keine Hindernisse aufgrund von nationalen oder
internationalen Vorschriften des Aussenwirtschaftsrechts sowie keine Embargos und|oder sonstige Sanktionen entgegenstehen.

Vom Versand generell ausgeschlossen sind derzeit:
Afghanistan, Belarus, Guinea, Guinea-Bissau, Irak, Iran, Israel, Jemen, Kuba, Libanon, Libyen, Nordkorea, Republik Mali, Republik Südsudan, Russische Föderation, Somalia, Sudan, Syrien, Tadschikistan, Turkmenistan, Ukraine, Usbekistan, Venezuela, Weißrussland

Diese Güter sind durch die U.S. Behörden kontrolliert (wenn sie mit "ECCN" ungleich "N" gekennzeichnet sind) und dürfen nur in das angegebene Land des Endverwenders geliefert
und nur durch diesen verwendet werden. Ohne eine Genehmigung der U.S. Behörden oder eine sonstige Genehmigung gemäss den U.S. Rechtsvorschriften dürfen die Güter nicht
in andere Länder oder an andere Personen, ausser dem angegebenen Endverwender, verkauft, transferiert oder auf sonstige Weise weitergegeben werden, weder in ihrer
ursprünglichen Form noch nach weiterer Verarbeitung in sonstige Güter. Die mit "AL" ungleich "N" gekennzeichneten Güter unterliegen der europäischen|nationalen
Ausfuhrgenehmigungspflicht. Für Güter ohne Kennzeichen, mit Kennzeichen "AL:N" |"ECCN:N" oder "AL:9X9999"|"ECCN: 9X9999" kann sich eine Genehmigungspflicht aufgrund
des Verwendungszwecks oder des Endverbleibs ergeben.

Einhaltung von Exportkontrollbestimmungen
Der Kunde hat bei Weitergabe der Lieferungen von  plc-auction (Hardware und|oder Software und|oder Technologie sowie dazugehörige Dokumentation,
unabhängig von der Art und  Weise der   Zurverfügungstellung) oder der von plc-auction erbrachtenDienstleistungen (einschliesslich technischer Unterstützung  jeder Art)
an Dritte die jeweils anwendbaren Vorschriften des nationalen und internationalen (Re-) Exportkontrollrechts einzuhalten. 
In jedem Fall sind bei Weitergabe der Lieferungen an Dritte die (Re-) Exportkontrollvorschriften der Schweiz Deutschland,
der Europäischen Union und der Vereinigten Staaten von Amerika zu beachten

Sofern zur Durchführung von Exportkontrollprüfungen durch Behörden oder durch plc-auction erforderlich, werden Sie plc-auction nach entsprechender Aufforderung unverzüglich
alle Informationen über den Endempfänger,  den Endverbleib und den Verwendungszweck der Lieferungen von plc-auction sowie diesbezüglich geltende
Exportkontrollbeschränkungen zur Verfügung stellen.

Der Kunde stellt plc-auction von allen Ansprüchen, die von Behörden oder sonstigen Dritten gegenüber plc-auctionw egen der Nichtbeachtung vorstehender
exportkontrollrechtlicher Verpflichtungen durch den Kunden geltend gemacht werden, in vollem Umfang frei und verpflichtet sich zum Ersatz aller plc-auction
in diesem Zusammenhang entstehenden Schäden und Aufwendungen.

8. Fake Käufer
plc-auction hat eine Null-Toleranz-Strategie gegenüber Fake-Käufern und Käufern, die das Rückgaberecht missbrauchen. Jeder Käufer wird sofort dauerhaft bei Ebay und in unserem System gesperrt. Ebenfalls wird der Fall an Ebay weitergeleitet.

Purchase transaction / Warranty / Returns / Customs / Delivery restrictions

1. Purchase

Upon purchasing the contractual products offered on eBay and in our web shop, you accept our General Terms and Conditions of Business and the policy outlined below.

Following your purchase, you will automatically receive an e-mail from us at your e-mail address that we have on record at eBay.

You will be asked, in said e-mail, to adapt your contact details (link to adapt your contact details), and you will also be informed about the shipping and customs procedure.

Should this data, which is mandatorily required, not be updated no later than 5 hours after the purchase, the item will be shipped to the address that we have on record at eBay.

After that, in accordance with our T&Cs, we do not provide any support, e.g. with delivery problems, taking items back if there are any customs problems, refusal to pay statutory VAT, amendments to invoices, etc. If we receive the data by 2 p.m. CET, the item is basically always shipped on the same day.

Once the data has been updated and the item has been paid for, you will receive our order confirmation, incl. T&Cs and returns policy. Only the T&Cs and returns policy of plc-auction will apply.

2. EORI / VAT ID

Commercial purchasers (traders) from Germany and Austria absolutely need to notify us of their EORI number. We cannot ship the goods without such number. It will also be sufficient if you forward us a copy confirmation of registration with the EORI by e-mail.

3. Prices

The prices are exclusive of Swiss VAT.

5. International “Incoterms CPT 2020” shipping

plc-auction only uses “Incoterms CPT 2020“

The place of delivery is always:  Friedberg 234 / 9427 Wolfhalden / Switzerland

“Incoterms CPT” obliges the seller, plc-auction, to clear the goods for export, if applicable.

The seller plc-auction is, however, not obliged to clear goods for import, pay import duties or complete import duty formalities.

CPT carriage paid (.. destination specified)

Incoterms “Carriage Paid To” means that the seller delivers the goods to the carrier or any other person specified by the seller at an agreed location.

In addition, the seller is required to conclude the contract of carriage and pay the freight charges incurred for transporting the goods to the destination specified.

6. Customs duties / Customs clearance / Taxes / Incoterms

The value of the item(s) contained in the consignment is listed, in accordance with the product type, on the customs forms for parcels that are despatched to countries outside Switzerland. In order to simplify the procedure for our customers, or based on a statutory obligation, we reserve the right to specify such details vis-à-vis the customs authorities.

The customs authorities may open parcels to check them. We have no control over that.

Customs or import duties are levied once the parcel has reached your country.

Any customs clearance fees shall be borne by you. Any additional fees for customs clearance need to be borne by the recipient. We have no control over these fees, and cannot predict the amount of them in advance. The customs regulations vary considerably from country to country. Should you require any further information, please contact your local customs authorities.

Any import duties due in your country must be borne by you. “Incoterms CPT 2020”

Note: The customs authorities of some countries require special proof of identity from the importer of goods prior to a consignment being cleared. As the importer of the goods, you or the recipient of the consignment may be required to give an identification number, e.g. the EORI number, a national identification number, CPF or taxpayer's ID.

plc-auction always declares the correct value of the goods.

Any enquiries aimed at achieving the manipulation of goods values are illegal, as per international commercial law, eBay T&Cs and plc-auction T&Cs.

We reserve the discretionary right to submit a complaint to your customs authority.

plc-auction does not issue T documents and proofs of origin.

7. Product-specific delivery restrictions

plc-auction shall fulfil this contract under the proviso that there are no obstacles to the fulfilment due to national or international regulations of foreign trade law, as well as no embargos and/or other sanctions.

The following countries are currently generally excluded from shipping:

Afghanistan, Belarus, Guinea, Guinea-Bissau, Iraq, Iran, Yemen, Cuba, Lebanon, Libya, North Korea, The Republic of Mali, The Republic of Southern Sudan, The Russian Federation, Somalia, Sudan, Syria, Tajikistan, Turkmenistan, The Ukraine, Uzbekistan and Venezuela.

These goods are controlled by the US authorities (if they are marked with “ECCN” not equalling “N”), and they may only be supplied in the respective country of the end user and used by them. Without the permission of the US authorities or another authorisation pursuant to US legal regulations, the goods must not be sold, transferred or passed on in any other way to other countries or other people, with the exception of the indicated end user, neither in their original form nor after having been processed into other goods. The goods marked with “AL” not equalling “N” are subject to European/ national export authorisation requirements. For goods without any markers, with the markers “AL N” / “ECCN N” or “AL 9X9999” /ECCN: 9X9999” there may be a permit requirement due to the purpose of use or the final destination.

Compliance with export control regulations

The customer shall comply with the corresponding applicable regulations of the national and international (re-)export control regulations when transferring the deliveries of plc-auction (hardware and/or software and/or technology, as well as any relevant documentation, irrespective of the way they have been made available) or in connection with the services provided by plc-auction (including technical support of any kind) to third parties. 

In any case the (re-)export control regulations of Switzerland, Germany, the European Union and the United States of America shall be complied with when deliveries are transferred to a third party.

In the event that it may be necessary that authorities or plc-auction carry out export control tests, you shall have to provide plc-auction after due request promptly with all  information  about the final recipient, the final destination and the purpose of use of the deliveries from plc-auction, as well as the corresponding applicable export control restrictions.

The customer shall hold plc-auction fully harmless from all claims any authority or a third party may assert against plc-auction due to non-compliance with the above mentioned obligations arising from export control regulations by the customer; and the customer shall undertake to reimburse plc-auction for any damage or expenses incurred in this connection.

8. Fake purchasers

plc-auction has a zero-tolerance strategy vis-à-vis fake purchasers, and purchasers who abuse the right of return. Any purchaser of this nature will immediately be permanently blocked from using eBay and also blocked in our system.
