Original 1853 handwritten New York Supreme Court appeal notice concerning the Oswego County case of John Hand, respondent, vs. Joshua Smith, appellant.
The document records an appeal from the Oswego County Court following its affirmance of a Justice's judgment and requests that the appeal be entered on the calendar for the next Supreme Court General Term.
The attorneys are identified as:
N. King — attorney for respondent John Hand
E. H. Richardson — attorney for appellant Joshua Smith
The document is signed N. King and gives his location as Liverpool, Onondaga County, New York. Research strongly indicates this was Nathaniel King of Liverpool, who is independently documented through a surviving manuscript volume titled Nathl. King Justice's Docket, recording his later work as a local justice.
King instructs the Oswego County clerk:
“The Clerk of Oswego Co. will please enter the above notice of appeal on the Calendar for the General Term to be held on the first Monday of April next.”
An informal handwritten postscript asks the clerk to “Please write me when done, & if it is right.”
An interesting piece of Oswego County and Onondaga County legal history, illustrating the appellate process from a local justice's judgment through County Court and onward to the New York Supreme Court General Term.
Reverse bears additional contemporary docketing and filing notations.
