TERMS AND CONDITIONS OF SALES

Machines are subject to ACT Inc’s terms & conditions below and notes:  The goods sold are second hand goods and ACT, Inc., Therefore makes no warranty of any kind, and sells goods “As is,” “As inspected,” And “With all faults”. ACT, Inc. makes no warranty of any kind whatsoever, specifically any warranty of merchantability or fitness for a particular purpose. ACT, Inc. disclaims any reliance by buyer on ACT Inc’s skill, or judgment to select or furnish the goods for any particular purpose, expressed or implied. Customer is responsible for all shipping & rigging costs.

STANDARD TERMS AND CONDITIONS OF SALE

TERMS:   All payments must be received within 10 business and prior to shipment of machine. All sales in CA are subject to applicable federal, state, and local use, sales and excise taxes which the Buyer agrees to pay, and which will be billed as part of the selling price, or separately, if the Seller is required by any taxing authority to collect and pay such a tax. 

PAYMENTS: We will email you an invoice for the full amount owed.  Please Do Not Pay until you have received our invoice.  Items not paid within 10 days from the end of sale, will be re-listed.  ACT Inc. accepts Wire Transfers and major credit cards with a 3% Prep Fee: Visa, Master Card, and American Express.  PayPal only accepted up to $2,000.00.

SHIPPING: Customer Is Responsible For All Packaging, Shipping & Rigging Costs.  No International Shipping.  Freight costs to be quoted at time of sale from zip code 92831.

Local pickup is ok.  Any item not picked up within 30 days from End of Sale, will be charged 10% of items cost per month for storage.

TITLE:  Title shall not pass to Buyer upon delivery of the goods, but shall remain vested in Seller until the entire purchase price and applicable taxes are paid in full. 

INDEMNIFICATION:  Buyer agrees to indemnify, hold harmless and defend Seller, its subsidiaries, affiliates or agents of and from any and all claims or liabilities involving, or alleged to involve, these goods, which are caused by acts or omissions of the Buyer, his employees, assigns or agents.

MACHINE USE AND SAFETY:  Buyer acknowledges that the goods described herein are pre-owned used goods, which were neither designed nor manufactured by the Seller.  Nor has the Seller knowledge of, or control over the future application of these goods by the Buyer.  It is the Buyer’s (user’s) responsibility to provide proper safety devices and equipment for any particular use, operation, or setup, and to take all necessary steps to conform to all federal, state, and local government safety standards, including OSHA.
