Offered here is a substantial original hand-engrossed late Victorian indenture on parchment, dated 17th December 1875, recording a Conveyance of Pieces or Parcels of Land situate at 1875 Antique English Indenture  in the County of Wiltshire, from The Reverend Rowland Newman of Shepton (Somerset), Clerk, to Mr. Isaac Pearce Watts of Westbury, Wiltshire, Gentleman, for the consideration of £240.

The history begins with an Indenture dated 7th April 1866 between Stephen Carpenter of the one part and James Horne of the other, under which the hereditaments were granted to Horne’s use subject to a proviso for redemption upon repayment of £3,500 with interest at the rate of four pounds per cent per annum on the seventh day of October then next. The mortgage included a full power of sale exercisable by Horne without further consent of Carpenter after default.

By a further Indenture dated 9th December 1872, between James Horne of the first part, Stephen Carpenter of the second part, and Francis [Beilly] Alston and the Honourable Robert Henry Wade (thereinafter referred to as “the said Transferors”) of the third part, in consideration of £3,535 7s. 6d. then paid by the Transferors, Horne assigned the principal sum of £3,500 and the interest thereon and the full benefit of the covenants, powers of sale, and other provisions of the 1866 Indenture, together with the hereditaments comprised therein, to the use of the said Transferors.

By a further Indenture dated 10th September 1875, between the said Transferors of the one part and Rowland Newman of the other part, in consideration of £3,535 7s. 6d. and seven shillings and six pence then paid by Newman, the Transferors assigned the principal sum of £3,500 and interest and the full benefit of the covenants, powers of sale, and provisions of the several hereinbefore recited Indentures to the use of Rowland Newman his heirs and assigns — subject to such right or equity of redemption as was then subsisting.

And whereas Rowland Newman, in exercise of the power of sale for this purpose contained in the said Indenture of Mortgage, contracted and agreed with Isaac Pearce Watts for the sale to him of the hereditaments in fee simple in possession free from incumbrances at the price of £240.

The Now this Indenture witnesseth clause recites that in consideration of £240 paid by Isaac Pearce Watts to Rowland Newman (receipt duly acknowledged), Newman doth hereby release and convey to Watts:

All that piece or parcel of Arable Land containing by a recent admeasurement one acre, one rood, and thirty-six perches (more or less), and

Also All that piece or parcel of Land containing by a recent admeasurement one acre, one rood, and twenty perches (more or less) — the remainder formerly used as gardens, now in the several occupations of James [—], John Wickham, and others — the whole of which said hereditaments are situate in the Parish of Sutton Veny in the County of Wiltshire.

The To Have and To Hold clause conveys the premises to Isaac Pearce Watts and his heirs discharged from all right and equity of redemption and all claims under the several hereinbefore recited Indentures. Rowland Newman covenants that he has not done or knowingly suffered any act whereby the premises are encumbered, and that the several hereinbefore recited Indentures relate to other hereditaments which remain subject thereto. Newman further agrees to produce the said Indentures to Watts his heirs or assigns at any trial, hearing, commission, or examination, and to keep the same safe, unobliterated, and uncancelled.

A receipt is endorsed on the document confirming receipt by Rowland Newman of £240 consideration money from Isaac Pearce Watts, signed by Rowland Newman and witnessed by Allen T. Edwards Junr., 228 South Lambeth Road.
