
The following terms and conditions apply to contracts concluded with us as the provider (Intelligenta GbR – Marius Moll + Ulla Köbel) via the eBay or CATCH by eBay platforms. Unless otherwise agreed, your own terms and conditions (if any) are expressly rejected.
A consumer, in the context of these provisions, is any natural person who enters into a legal transaction for purposes that are primarily neither commercial nor self-employed. An entrepreneur is any natural or legal person or a legal partnership acting in the exercise of their commercial or independent professional activity when concluding a legal transaction.
The subject of the contract is the sale of goods.
When we post an item on eBay or CATCH by eBay, this constitutes a binding offer to conclude a contract under the terms stated on the item page.
The contract is concluded through various online purchasing functions (as offered on the respective item page) as follows:
After clicking the "Buy It Now" button, you can log into your existing eBay account or create a new one. You’ll then be taken to the "Ship to" screen where your stored personal data will appear. You then select your payment method.
If offered, you can alternatively check out as a guest. You’ll then enter your personal information and select your payment method.
Afterward, the order summary is displayed.
If using an instant payment method (e.g., PayPal, Apple Pay, Google Pay), you’ll be directed to the payment provider’s site or shown the order summary on eBay. You’ll complete payment on the provider’s page or after returning to eBay.
Before submitting the order, you can check, edit, or cancel it.
By clicking the corresponding button (e.g., Buy, Pay Now, etc.), you accept the offer and the contract is concluded.
Clicking "Add to Cart" adds the item to your cart. You can view and edit the cart anytime.
Clicking "Proceed to Checkout" or "Secure Checkout" brings you to login or registration. Then you’ll see the "Ship to" screen and choose your payment method.
If guest checkout is offered, you may also proceed that way.
You’ll then see the order summary before submitting.
By clicking the corresponding button (e.g., Buy, Pay Now), you accept the offer and the contract is concluded.
During the offer period, you may place a bid following eBay’s bidding rules. If we’ve set a minimum price, your bid must meet it.
After entering your bid and clicking "Bid", you log into your eBay account.
On the next page, you can check, edit, or cancel your bid.
Clicking "Confirm" submits your bid and legally accepts the offer.
The contract is concluded only if your bid is the highest at the time the auction ends. If a higher bid is placed before the end, your lower bid expires.
You may send us an offer lower than the listed price.
Click "Make Offer", log in or register, and submit your price and offer duration.
Click "Review Offer" to check or cancel.
Clicking "Submit Offer" sends a binding offer. You are bound to it for up to 2 days, depending on your selection.
The contract is concluded if we accept your offer within that timeframe.
Order processing and communication of contract information is by email, partially automated. You must ensure that your email address is correct and able to receive messages (especially not blocked by spam filters).
You may only exercise a right of retention if it relates to claims from the same contract.
The goods remain our property until full payment is received.
Statutory warranty rights apply.
Consumers are encouraged to promptly check the goods for completeness, visible defects, and transport damage and report any issues to us and the carrier. Failure to do so has no effect on statutory warranty rights.
Deviations from objective characteristics are only valid if you were informed of them before contract conclusion and the deviation was explicitly agreed upon.
German law applies. For consumers, this only applies if no mandatory protections of their home country are removed.
The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.

Alternative dispute resolution:
The EU Commission provides an online dispute resolution platform (OS platform).
We are neither willing nor obliged to participate in dispute resolution before a consumer arbitration board.
The technical steps and procedures for concluding a contract, and how to correct errors, follow § 2 of our General Terms and Conditions (Part I).
3.1. The contract language is German.
3.2. We do not store the full contract text. Before submitting your order, the contract data can be printed or saved using your browser. After ordering, we send the legal contract information and terms again by email.
The main features can be found in the respective offer.
5.1. Prices include all taxes and fees.
5.2. Shipping costs are not included unless stated otherwise. These are shown separately during checkout.
5.3. Deliveries outside the EU may incur additional costs (customs, taxes, transfer fees), which you must pay.
5.4. Transfer fees from non-EU banks are your responsibility, even for delivery within the EU.
5.5. Available payment methods are listed on our site or in the offer. You may also use Apple Pay and/or Google Pay if displayed during checkout.
5.6. Unless stated otherwise, payments are due immediately upon contract conclusion.
6.1. Delivery times and restrictions are shown on our site or in the offer. If not otherwise stated, goods are delivered within 3–5 days after contract conclusion (after payment if prepayment is required).
6.2. Risk passes to the consumer only upon delivery, even if untracked shipping is used. This does not apply if you chose your own courier.
Warranty rights are governed by § 4 of our General Terms and Conditions.

We only collect and process personal data necessary for fulfilling your order and handling inquiries. Without it, we cannot conclude a contract. This is done under Art. 6(1)(b) GDPR.
Data may be shared with shipping companies, dropshipping or fulfillment providers, payment processors, order processing providers, and IT services. Only the minimum required data is shared, and legal requirements are strictly observed.
We use PayPal (Europe S.à.r.l. et Cie, S.C.A., Luxembourg). Your payment data will be transferred to PayPal to complete your order as selected. This is in accordance with Art. 6(1)(b) GDPR.
All PayPal transactions follow PayPal's privacy policy.
This includes PayPal, credit card via PayPal, and direct debit via PayPal. If you choose one, data necessary for processing will be transmitted to PayPal.
In some cases, PayPal may perform a credit check based on mathematical-statistical methods. Your personal data (e.g., name, address) may be sent to a credit agency for this.
This is based on Art. 6(1)(f) GDPR, due to PayPal’s interest in avoiding defaults.
You may object to this processing at any time by notifying PayPal.
Non-provision of data prevents using the chosen payment method.
We use Klarna (Klarna Bank AB, Stockholm, Sweden). Your payment data is transmitted to Klarna to process your order with the selected method (e.g., “Pay Later,” “Pay Now,” “Financing”).
Cookies may be used, per Art. 6(1)(f) GDPR, in Klarna’s interest in offering user-friendly payment options.
You may object to this processing at any time.
For some methods, Klarna may conduct a credit check, sending personal data (name, address, email, IP, etc.) to a credit agency.
This serves to verify identity and assess payment risk. Score values may be calculated based on accepted statistical methods and address data.
This processing is carried out under Art. 6(1)(f) GDPR. Your rights are protected by law.
