Payment

Shipping

Non-DOA Guarantee

• Seller provides a limited 5 day non-DOA (Dead on Arrival) guarantee.
• If a defective item is received, Buyer must contact Seller within 5 days following receipt of the item to initiate a return. Please do this by messaging Seller directly for further instructions.
• Item must be returned in the same condition as received.
• Any physical or software alterations to the product automatically voids this guarantee.

Fraud Mitigation

• In order to limit fraud, Seller maintains a list of unique product identifiers, such as serial numbers.

SELLER SHALL NOT BE LIABLE FOR ANY DAMAGES RELATED TO PERSONAL INJURY TO ANY PERSON OR PERSONS, PHYSICAL INJURY OR DEATH TO ANY PERSON OR PERSONS, OR ANY PROPERTY DAMAGE STEMMING FROM THE PURCHASE AND/OR USAGE OF THIS PRODUCT. Indemnification

Buyer agrees to indemnify, defend, and hold harmless Seller from and against any and all losses, liabilities, demands, claims, actions, suits, expenses, costs, damages, settlements, including, but not limited to, reasonable attorney's fees and costs, of whatever type or nature, including, but not limited to, damage or destruction of property, physical injury or death to any person or persons, or personal injury to any person or persons, which are asserted against, incurred, imposed upon, or suffered by Seller by any reason of or arising from usage of the product.

Jurisdiction of the Courts

• This sale shall be governed by the internal laws of the State of New York.
• All disputes will be litigated exclusively in the federal, state, or small claims courts of Suffolk County, New York, United States.
• Each party shall bear their own legal fees, including reasonable attorney’s fees, except where this Terms and Conditions Agreement provides for the recovery of reasonable attorney’s fees. The prevailing party in the dispute may be awarded court costs.

Other Terms

If any provision of this Agreement shall be unlawful, void, or unenforceable, for any reason, the other provisions, and any partially enforceable provision, shall not be affected thereby and should remain valid and enforceable to the maximum possible extent.
