We try to make sure our images and description truly reflect the product being sold. However, please note that when purchasing used body / exterior panels you should purchase this on the assumption that they are not of showroom condition. Used panels and exterior items will always have scratches, scuffs, swirl marks, and other age related wear to paintwork. Our description will describe any damage, deformity, dents or splits but purchase on the assumption that paintwork restoration or re spraying will be required to make the panel back to showroom condition. We will never describe an exterior body panel as scratch less.
TERMS OF SALES - By purchasing an item from us, you are accepting the following terms and we recommend you read carefully.
I, the Buyer, understand and appreciate Wicks Performance Engineering Ltd trading as RRD (“Seller”) provides new, used and take-out automotive parts, accessories and consumables. Used and take-out parts are not in new nor remanufactured condition when purchased from Wicks Performance Engineering Ltd, that these parts, are used and sold AS-IS, and that no warranty, express or implied, is given for the parts, or any services provided by the seller. No warranty on labour. Shipping is non-refundable.
I, the Buyer, do hereby agree that Wicks Performance Engineering Ltd has no control over the installation and use of parts once sold. I also understand that Wicks Performance Engineering Ltd highly recommends that certified professionals install all parts that it sells.
I, the Buyer, agree that I rely on my own skill and judgment in evaluating the installation of parts bought from Wicks Performance Engineering Ltd, and I agree that I am solely responsible for the part’s use.
I, the Buyer, agree to hold the Seller Wicks Performance Engineering Ltd harmless from, and hereby assume the entire responsibility and liability for, any and all damage or injury of any kind or nature whatever, including death, as to all persons, whether Buyer's employees, agents or otherwise, and as to all property, including Buyer's own property, caused by, resulting from, arising out of, or occurring in connection with the use by Buyer or any other person, of any parts, or vehicle serviced by and or purchased from Wicks Performance Engineering Ltd.
I, the Buyer, agree that if any person makes a claim for any damage or injury, including death, resulting from the use of the parts, vehicle Buyer purchased from Seller, whether based upon Seller's alleged active or passive
negligence, or based upon principles of product liability, or based upon any alleged breach of any statutory/contractual or common law duty or obligation Seller may have, I shall defend, indemnify and hold harmless Seller, its agents, servants and employees, from and against any and all loss, expense, damage or injury that Seller may sustain as a result of any such claim.
All used parts must be inspected by buyer for defects or safety hazards. Wicks Performance Engineering Ltd in no way guarantees or warrants used Parts or vehicles for apparent or non-apparent safety hazards and affirmatively states that used parts or merchandise sold may have safety hazards, and it is the responsibility of buyer to inspect for actual or latent safety hazards or hire an expert to so inspect.
Buyer affirms that before he has entered into this agreement. Wicks Performance Engineering Ltd requested that buyer examine the parts, to ascertain whether there were defects therein; Wicks Performance Engineering Ltd. afforded to buyer an adequate opportunity to make such examination before he entered into this agreement and that he has examined the goods as fully as buyer desires for the purpose of determining whether there are defects. I, the Buyer, for myself and anyone entitled to act on my behalf, waive and release Wicks Performance Engineering Ltd, its members, shareholders, officers, directors, agents, volunteers and employees, from all claims or liabilities of any kind.
I, the Buyer, understand that some components are supplied with ‘tamper evident security seals’. I, the Buyer, understand that should a component be supplied with a tamper evident security seal, that this seal must remain intact should I wish to return the product for any reason. I, the Buyer, understands that should the tamper evident security seal be removed, damaged, or display ‘VOID’, then Wicks Performance Engineering Ltd, trading as RRD (“Seller”), may refuse the right for the buyer to return the item or request any form of refund. I, the buyer, understands that should an item be returned, the tamper proof security seal must remain intact and fixed to the component. I, the buyer, understands that RRD (“Seller”) keeps detailed records of security seals and comprehensive logs of which security seal is paired with what component, with what order / buyer.
