ENGINEQUEST LLC LIMITED WARRANTY:

Original Equipment Manufacturer (OEM) Type Replacements - Subject to the terms of this warranty, ENGINEQUEST LLC warrants to the original purchaser that for 12 months from date of purchase from ENGINEQUEST or the length of the engine warranty, whichever is earlier, the product sold by us with this warranty shall be free of defects in material and workmanship under normal use and with periodic maintenance as recommended by the OEM subject to the following terms and conditions.

Non OEM-Type Replacements (including those designed for racing, performance and hot rod applications)- Subject to the terms of this warranty, ENGINEQUEST LLC warrants to the original purchaser that at the time of purchase, the product sold by us with this warranty shall be free of defects in material and workmanship. FOR CLARITY, THIS WARRANTY IS NO LONGER VALID AND ENGINEQUEST SHALL HAVE NO LIABILITY ONCE THE NON OEM-TYPE REPLACEMENT PRODUCT IS INSTALLED, MODIFIED OR USED.

TO THE EXTENT NOT PROHIBITED BY LAW, THESE ARE ENGINEQUEST'S ONLY WARRANTIES. EXCEPT FOR THE WARRANTY ABOVE AND TO THE EXTENT NOT PROHIBITED BY LAW, ENGINEQUEST MAKES NO WARRANTY WHATSOEVER WITH RESPECT TO ANY PRODUCT, INCLUDING, WITHOUT LIMITATION, ANY (i) WARRANTY OF MERCHANTABILITY; (ii) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; OR (C) WARRANTY AGAINST INFRINGEMENT; WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE OR OTHERWISE. SOME STATES DO NOT ALLOW DISCLAIMERS OF IMPLIED WARRANTIES, SO THIS DISCLAIMER MAY NOT APPLY TO YOU. TO THE EXTENT SUCH WARRANTIES CANNOT BE DISCLAIMED UNDER THE LAWS OF YOUR JURISDICTION, WE LIMIT THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY.

REMEDY: Subject to limitations listed herein, ENGINEQUEST, at its option, shall repair or replace a product during the warranty term after determination by ENGINEQUEST that the product is defective. In the alternative, at ENGINEQUEST’S option, ENGINEQUEST may refund the actual purchase price received by ENGINEQUEST for such product. These are the sole remedies available to purchaser.  All repairs or replacements covered by this warranty must be authorized in advance by ENGINEQUEST. We assume no liability unless we are contacted before any work is done and agree in writing that it is authorized to be performed. The warranty period is not extended if ENGINEQUEST repairs or replaces the product.

LIMITATIONS: This warranty only applies to products originally supplied directly by ENGINEQUEST. This warranty is not transferrable and does not apply to or include any of the following: (1) damage as a result of an act of God, misuse, abuse, accident, over-heating, lack of lubrication, contamination, or improper use, installation, operation or maintenance; (2) repair or replacement of any accessory or service item, including but not limited to: (a) all components of the cooling, fuel, electrical and ignition systems; and (b) all belts, hoses, and filters; (3) any product used for competition, racing, performance, hot rod or similar or related purposes; (4) any product to which a device or accessory not conforming to original manufacturer's specifications has been installed or removed; (5) any product on which periodic maintenance services required by the OEM have not been performed; and (6) any product that has been modified or disassembled without the prior written authorization from ENGINEQUEST. To be valid, crankshaft warranty requires installation of new harmonic balancer at time of crankshaft installation.

LIMITED LIABILITY: ENGINEQUEST SHALL NOT BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY,  OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS OR PRODUCTION OR COMMERCIAL LOSS IN ANY WAY (including, without limitation, for rental cars or towing fees), REGARDLESS OF WHETHER SUCH CLAIM IS BASED IN CONTRACT, WARRANTY, TORT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER THEORY OF LIABILITY, EVEN IF ENGINEQUEST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Further, in no event shall the liability of ENGINEQUEST exceed the individual price of the product on which liability is asserted.

STANDARD REIMBURSEMENT FOR LABOR: The amount of Labor credit for repairs will be determined by multiplying the standard labor rate per hour (based on your area, not to exceed $40.00 USD) by the factory time shown in Chilton's and Motor's manuals. Not to exceed $250.00.

LAW: These terms are governed by Nevada law without giving effect to any choice or conflict of law provision or rule (whether of the State of Nevada or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than those of the State of Nevada..  There are no third-party beneficiaries. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. 

No dealer nor any agent or employee thereof, is authorized to extend or modify this warranty. This warranty may be distributed in a state(s) which may not allow the limitation or exclusion of some warranties or of incidental or consequential damages. In the event that any provision of this warranty should be or become invalid or unenforceable, the remaining terms and conditions hereof shall remain in full force and effect. All returns must be accompanied by a Return Goods Authorization (RGA) issued by Customer Service.
