This is a new, sealed in the package Marvel Heroes Die-Cast Phoenix DP350 toy car from MGA Entertainment. It was released in 2006 and is 1:64 scale.

The package may have some wear, such as bent corners or shelf wear. The original price sticker is on the front. It was purchased at retail and has been stored in boxes for 20+ years.
