1. General Terms and Conditions

1.1 Installation Requirement

If the Item/s are wired electrical products, the Buyer must ensure that they are installed by a qualified electrician in compliance with all relevant local and national regulations and the manufacturer’s official installation guidance, whether supplied by the Seller or not. If such guidance is not provided by the Seller, it is the Buyer’s responsibility to obtain it from the manufacturer or other publicly available sources.

Failure to install the Item/s correctly and in accordance with the manufacturer’s guidance may result in malfunction or damage, for which the Seller accepts no liability.

1.2 No Implied Testing or Warranty

If the Item/s are supplied with a warranty (if any), such warranty does not imply that the Seller has tested the Item/s.

Unless explicitly stated otherwise, the Seller has not tested the Item/s and makes no representation as to their functionality, performance, or safety.

The Buyer must assume the Item/s are non-functional until they have been tested and verified to be in working condition.

The Buyer is responsible for conducting all necessary testing as set out in Section 1.3 (Buyer's Obligation to Test).

1.3 Buyer's Obligation to Test

The Seller has not tested the Item/s unless expressly stated.

The Buyer must test the Item/s upon receipt to verify their condition and functionality. If the Buyer is not qualified to conduct these tests, they must engage a qualified third party to do so.

If the Item/s fail the required tests, the Buyer may return them under eBay's standard terms or any applicable Seller-provided warranty (if any), subject to Section 2 (Warranty Terms & Conditions).

1.4 Limitation of Liability

To the maximum extent permitted by law, the Seller’s total liability under any circumstances shall not exceed 150% of the original purchase price of the Item/s, excluding taxes, shipping, and ancillary costs.

The Seller shall not be liable for any:

  • Direct, indirect, incidental, or consequential losses, including but not limited to loss of profits, revenue, business, or data.
  • Damage to property or personal injury, including loss of life, resulting from the use, installation, or modification of the Item/s.
  • Liabilities arising from third-party claims, including damage caused by incorrect installation, modification, or use of the Item/s.
  • Costs incurred by the Buyer in relation to testing, installation, or troubleshooting the Item/s.

1.4.1 B2C and B2B Liability Differences

For B2C transactions:

Nothing in these Terms & Conditions shall limit statutory rights available to consumers under the Consumer Rights Act 2015.

For B2B transactions:

The Seller excludes all implied warranties, including those of merchantability, fitness for purpose, and non-infringement, to the fullest extent permitted by law.

The Sale of Goods Act 1979 and Unfair Contract Terms Act 1977 shall apply only where they cannot be excluded by contract.

1.5 Indemnification

The Buyer agrees to indemnify and hold harmless the Seller against any claims, damages, liabilities, costs, and expenses (including legal fees) arising from:

  • The installation, use, or resale of the Item/s.
  • Any failure to comply with installation guidelines, legal requirements, or safety regulations.
  • Any third-party claims resulting from the Buyer’s use or resale of the Item/s.

1.6 Legal Jurisdiction & Compliance

These Terms & Conditions, including any warranty terms, are governed exclusively by the laws of England.

Both the Seller and Buyer submit to the exclusive jurisdiction of the courts of England.

If the Buyer is a consumer (B2C sale), their statutory rights remain unaffected.

If the Buyer is a business (B2B sale), the sale is subject to the Sale of Goods Act 1979 and Unfair Contract Terms Act 1977, only where these laws cannot be excluded by contract.

1.7 Conflict with eBay Terms

If these Terms & Conditions conflict with eBay's terms, eBay's terms shall prevail.

1.8 Severability Clause

If any provision of these Terms & Conditions is found to be unlawful, unenforceable, or invalid:

  • The remainder shall remain in full effect.
  • The parties shall, in good faith, amend the provision to the minimum extent necessary to make it valid and enforceable.
  • If modification is not possible, the provision shall be deemed deleted without affecting the rest of the Terms & Conditions.

1.9 Non-Estoppel, Non-Waiver & Non-Variation

Non-Estoppel & Non-Waiver

For B2B transactions, no failure, delay, or omission by the Seller in enforcing any right, remedy, or provision under these Terms & Conditions shall be deemed a waiver of such right or provision. Any waiver must be expressly stated in writing and signed by the Seller. The exercise or partial exercise of any right or remedy shall not preclude the further exercise of that or any other right or remedy.

For B2C transactions, no failure, delay, or omission by either party in enforcing any right, remedy, or provision under these Terms & Conditions shall be deemed a waiver of such right or provision. Any waiver must be expressly stated in writing and signed by the waiving party.

No act, omission, or course of dealing between the parties shall be construed as a modification of any provision of these Terms & Conditions unless explicitly agreed in writing.

Non-Variation & Non-Alteration

These Terms & Conditions may not be varied, amended, or altered unless expressly agreed in writing and signed by a director of the Seller. Any purported variation, amendment, or alteration that does not meet this requirement shall be void and of no effect.

2. Warranty Terms and Conditions

2.1 Warranty Scope & Disclaimer

A warranty is only offered if explicitly stated in the listing title. The inclusion of these warranty terms does not, in itself, indicate that a warranty is provided. Any warranty, if offered, is solely provided by Rosette Electrical and not by the original hardware manufacturer.

If a warranty is offered, it is limited and back-to-base only, meaning the Buyer must contact the Seller before submitting a warranty claim. The Buyer is responsible for returning the Item/s to the Seller at their own cost.

The warranty does not imply that the Seller has tested the Item/s. The Buyer must still perform testing as per Section 1.3 (General Terms & Conditions).

The warranty applies only to the functionality of the Item/s and does not extend to any costs associated with installation, removal, troubleshooting, or third-party services.

2.2 Warranty Period

The warranty starts from the date of purchase and lasts for the period stated in the eBay listing.

2.3 Non-Transferable Warranty

The warranty applies only to the original Buyer and cannot be transferred to any third party.

2.4 Exclusions from Warranty

The warranty does not cover:

  • Cosmetic damage, scratches, or minor defects.
  • Normal wear and tear after delivery to the Buyer.
  • Any damage caused by misuse, incorrect installation, or modifications.
  • Any failure due to electrical surges, overloading, water damage, or external factors beyond the Seller's control.
  • Any costs related to import/export customs duties, taxes, or clearance fees on returned warranty items. The Buyer is solely responsible for these costs.

2.5 Installation & Testing Requirements for Warranty Validity

The Item/s must be installed and tested with reasonable skill and care by competent tradespeople.

For electrical items:

  • The Item/s must be installed by a qualified electrician who holds valid Professional Indemnity (PI) Insurance and Public Liability (PL) Insurance.
  • If the Item/s are covered by an approved installer scheme, installation must be carried out by an installer accredited under that scheme.
  • The Seller is entitled to request full policy terms, documentation, and proof of coverage for Professional Indemnity (PI) Insurance and Public Liability (PL) Insurance of the installer/s before processing a warranty claim.
  • Failure to provide this documentation may result in the claim being rejected.

Failure to comply with these requirements may affect warranty eligibility.

2.6 Buyer's Obligations Before Making a Warranty Claim

Before submitting a warranty claim, the Buyer must first contact the Seller. The Seller will attempt to troubleshoot the issue and may request additional information to determine whether a warranty claim is valid.

If troubleshooting does not resolve the issue, the Buyer must:

  • Engage a qualified professional to verify and troubleshoot the issue.
  • Contact the item manufacturer’s technical support and make reasonable efforts to resolve the problem.
  • Provide the Seller with an email or documentation from the manufacturer’s technical support, detailing the issue and all troubleshooting steps taken.

Failure to follow these steps may result in the claim being delayed or rejected.

2.7 Warranty Return Process

If a warranty return is accepted:

  • The Buyer must pay for all return shipping, insurance, and any associated costs.
  • The Buyer must insure the Item/s for the original purchase price during shipment.
  • The Buyer must ensure the Item/s are properly packaged to prevent damage during return shipping.
  • Any import/export customs duties, taxes, or clearance fees incurred on returned items are the Buyer’s responsibility.

2.8 Warranty Void Conditions

The warranty may be void if:

  • The Item/s have been altered, repaired, misused, or modified by the Buyer or a third party.
  • The Item/s were not installed by a qualified electrician where required or were not installed with reasonable skill and care.
  • The Buyer is unable to provide proof that installation was carried out by an appropriately insured professional where applicable.
  • The Buyer does not cooperate in troubleshooting or fails to provide relevant documentation from the manufacturer’s technical support when required.
  • The Item/s are covered by an approved installer scheme, and installation was not carried out by an accredited installer under that scheme.

2.9 Seller's Warranty Remedies

Upon receiving the returned Item/s under a valid warranty claim, the Seller may, at their sole discretion:

  • Repair the Item/s and return them to the Buyer.
  • Replace the Item/s.
  • Issue a refund at the original purchase price, minus shipping, taxes, and ancillary costs.

The Seller will process warranty resolutions within 8 weeks of receiving the returned Item/s.
