The package has wear.

There is a slice/puncture on the clear plastic.

The figure has not been played with or removed from package but has some marks.

From what I can see from the description and artwork on the packaging, the manufacturers of this figure appear to have been "inspired" by a certain robotic law enforcement officer from Detroit, a crime fighting unit that fought Crooks and a super-hero team founded by a guy that has a school for gifted children. 

This item comes from a non-smoking home with no pets.
