Seller will not be held responsible or liable for any damages arising
out of the installation or use of the Part, including but not limited to,
direct, indirect, consequential, incidental, compensatory, punitive, and/or
special damages, whether in action or under contract, tort, or otherwise. Seller’s liability is, in all events, limited
to (and may not exceed) the price paid for the Part. Further, Buyer agrees to indemnify, defend,
and hold harmless Seller for any loss, damages, or injury that may occur as a
result of the installation and/or use of the Part, including (but not limited
to) loss, damages, or injury to any third party.
