The Purchaser and seller agrees that the Arbitrator shall have the power and the legal right to Enforce the Agreement and or make judgements that are binding in law. English shall be the language to use in the arbitration Process and in communications in good faith prior to Arbitration. In the event that the Purchaser refuses to pay for the Arbitration, that the seller can recoup this cost as part of any judgement of arbitration that the arbitrators shall enter and enforce. Both the seller and the purchaser agree to pay the costs of the others attorneys fees upon losing as a part of the arbitration cost, but that the purchaser shall be responsible for the arbitration costs of the attorney(s) who are the arbitrators. The Purchaser and Seller have the right to recoup as a part of the Arbitration any lost time from work, damage to reputation, the cost of the Product in question, to include the product costs, repair of the product costs, Insurance costs, Packaging and shipping costs, as per the arbitrator's final judgement on the matter. The Purchaser shall agree that if any action is taken that they purchaser shall give consent by this purchase for the buyer to gain access or subpoena records that are relevant to find the true identity of the buyer to include Credit Card Companies address and phone numbers on file for the buyer, the location data from the phone company, location and addresses of the phones usage logs and any texts that are relevant to find the location and or identity of the buyer of this product or their agents. That any such costs of trying to locate the buyer shall be paid by the buyer if the buyer refuses to disclose this information. That both the purchaser and the seller both agree that neither one will willingly, willfully or knowingly defame or cause to defame the other with slanderous, Malicious accusations or lies without proof of any of the before mentioned activity outside of the arbitration process or a court of law. This action is also to add that if the parties are from separate states, both parties agree to the Sovereign doctrine where this action can be take in either Federal Jurisdiction or State Jurisdiction or both since these acts are a separate sovereign and are separate in laws governing state and federal Jurisdiction. That the seller and buyer agree that the location of the Arbitration of both State and Federal Arbitration claims and actions are Gaston County, North Carolina. This provision shall also cover using "Ghost" or false accounts, or accounts under your current or another persons name to purchase an item just to leave negative feedback in an attempt to defame the seller. It shall be on the Buyer to prove their negative feedback was justified through actual proof to include written messages, phone conversations, Mail conversations or any electronic means of communicating that can be viewed, proofed and proven in a court of law or in an arbitrators office. Such proof shall include the item itself to show the defects that are depicted in the reasons for the dispute. The Buyer shall at the request of the seller, provide a written explanation for the negative feedback to include the reasons why this feedback was left. If the buyer cannot explain why the negative Feedback was left before arbitration begins, then the arbitrator shall be able to take into consideration of the fact that the buyer never provided within 30 Calendar days to resolve the issues in good faith as a sign that the buyer is being Vengeful, vindictive and malicious with their legal intent and obligations. This arbitration clause shall cover anyone who purchases an item and returns a damaged or defective item, or no Item at all for a refund of their money. This shall be proven by video of the item being unpacked in the Presence of a postal employee and the item visually inspected with the camera to prove the item is the same as the item in the pictures from the listing. If the Item is not the same as the listing, then Upon consideration, the seller shall contact the buyer and if the buyer does not drop any disputes on Ebay, also to include any Negative or Neutral feedback or Positive feedback with a negative message that a reasonable person can construe as damaging to the sellers reputation, then the seller has the right to bring an action under Arbitration as set forth in this clause in the county of Gaston, North Carolina, To use the English Language and to seek damages that the Arbitrator shall after hearing a preponderance of the evidence give a ruling as to the damages and awards not to exceed $250,000 or less than $10,000. Such costs may include bit are not limited to, Private Investigators, Costs of filing, attorneys fees, court costs, penalties, interest, etc. Any action may be put on hold an additional 30 calendar days after the suit is brought to arbitration if the party requesting the hold on action can prove that they had either a medical emergency or a legal requirement that requires them to legally be present at another location during this time that is outside of their immediate control. This can be a serious medical emergency, injury, Military call for duty, incarceration etc. A stay of action can only be used once per party in this action. At the end of the requested hold, the parties shall meet for arbitration at the stated location of Gaston County, North Carolina, in the English language, at the time and place the arbitration shall begin. As per the upper statement the Buyer agrees to pay for arbitration for all actions brought only after good faith attempt to resolve the problem has been performed. (In the event any part the provision about the buyer paying for the Arbitration is ruled illegal, invalid, unconscienable under the law etc. then the losing party shall pay for the arbitration as part of the judgement).
